BeforeTheyGo Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of BeforeTheyGo, including the BeforeTheyGo mobile app, website, and related services (collectively, the "Service"). BeforeTheyGo is operated by Hamza Mhaidy ("BeforeTheyGo," "we," "us," or "our").
By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
These Terms are intended to describe the rules for using BeforeTheyGo clearly. They are not a substitute for legal advice.
1. Who May Use BeforeTheyGo
BeforeTheyGo is intended for adults age 18 and older. It is not directed to children and is not intended for the App Store Kids Category.
You may use the Service only if you can form a binding agreement with us and only in compliance with these Terms and all applicable laws.
2. What BeforeTheyGo Provides
BeforeTheyGo is a private reflection and memory-capture app that helps users connect with a parent or loved one through prompts, written reflections, audio recordings, photos, videos, journal entries, and related memory features.
The Service may include features that let you save prompts, complete moments, record voice memories, save photos or videos, sync content across authenticated sessions, export your data, and turn reflections into personal letters or similar keepsakes.
BeforeTheyGo is designed for personal reflection and memory preservation. It is not a medical device, therapy service, counseling service, crisis service, or emergency service. The Service does not provide medical, mental health, legal, financial, or professional advice.
If you or someone else may be in danger, may harm themselves, or needs urgent help, contact local emergency services or an appropriate crisis support provider immediately.
3. Your Account
Some features may require an account. Depending on the sign-in methods we make available, you may be able to create or access an account using email sign-in, Sign in with Apple, Google sign-in, or another supported authentication method.
You are responsible for keeping your account credentials and devices secure. You are also responsible for all activity that occurs through your account, except to the extent caused by our failure to use reasonable security measures.
You agree to provide accurate account information and to keep your account information reasonably current.
4. Your Content
"Your Content" means reflections, prompts, parent profile details, names, emojis, photos, videos, audio recordings, captions, journal entries, exported files, and any other materials or information you create, record, upload, store, sync, or submit through the Service.
You keep ownership of Your Content. By using the Service, you grant us a limited, non-exclusive, worldwide license to host, store, copy, process, display, transmit, back up, export, and otherwise use Your Content only as needed to provide, maintain, secure, troubleshoot, and improve the Service and as otherwise described in our Privacy Policy.
You are responsible for Your Content. You represent that you have all rights, permissions, and consents needed to create, record, upload, store, sync, export, or share Your Content through the Service.
Because memories may include another person's voice, image, words, likeness, personal information, or private experiences, you are responsible for getting appropriate consent before recording, photographing, filming, uploading, storing, or sharing another person's information or content.
5. Acceptable Use
You agree not to:
- Use the Service for unlawful, harmful, deceptive, abusive, harassing, defamatory, invasive, or exploitative purposes.
- Record, photograph, film, upload, or share another person's voice, image, words, likeness, or personal information without any consent required by law.
- Upload content that infringes another person's intellectual property, privacy, publicity, confidentiality, or other rights.
- Upload malware, harmful code, or content intended to disrupt, damage, overload, or compromise the Service.
- Attempt to access another user's account, content, device, or data without permission.
- Reverse engineer, decompile, modify, or create derivative works of the app except to the extent applicable law allows.
- Bypass, disable, or interfere with security, authentication, entitlement, subscription, sync, storage, or access-control features.
- Use the Service to make medical, mental health, emergency, legal, financial, or other professional decisions.
We may remove content, restrict access, suspend accounts, or terminate access if we reasonably believe these Terms have been violated, if required by law, or if needed to protect users, the Service, or third parties.
6. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you use the Service. By using the Service, you acknowledge that your information will be handled as described in the Privacy Policy.
If there is a conflict between these Terms and the Privacy Policy about how we handle personal information, the Privacy Policy controls for that issue.
7. Device Permissions, Local Data, Sync, Export, and Deletion
The Service may request access to device features such as the camera, microphone, photo library, media picker, local storage, or similar permissions only when needed for app functionality. You can manage device permissions through iOS Settings.
Some data may be stored locally on your device. If you sign in and use sync features, account data and user content may also be uploaded to service providers such as Supabase so the Service can provide backup, restore, sync, and account functionality.
You may be able to export your data through the app. Once an exported archive leaves the app, you are responsible for where it is saved, stored, sent, or shared.
If account deletion is available in the app, you may use it to request deletion of your account and synced cloud data. Deleting the app from your device may remove local data from that device, but it may not delete synced cloud data. Some records may remain as described in the Privacy Policy, including backups, logs, billing records, legal records, and records kept by third-party services such as Apple or RevenueCat.
8. Subscriptions, Purchases, and Billing
BeforeTheyGo may offer paid features, subscriptions, free trials, introductory offers, or other in-app purchases. Paid digital features made available in the iOS app are processed through Apple's App Store and StoreKit unless Apple permits another method in a particular region or storefront.
If you purchase an auto-renewable subscription, your Apple Account will be charged according to the price, duration, trial, renewal, and cancellation terms shown to you before purchase and in the App Store purchase flow. Subscriptions renew automatically unless canceled before the end of the current billing period.
You can manage or cancel App Store subscriptions in your Apple Account settings. Cancellation generally takes effect at the end of the current paid period, and you may continue to have access to paid features until that period ends unless Apple or applicable law provides otherwise.
Apple handles App Store billing, taxes, payment methods, refunds, chargebacks, subscription management, and related purchase records. We do not receive your full payment card number. Refund requests for App Store purchases are handled by Apple under Apple's policies.
RevenueCat may be used to help us manage subscription entitlements, purchase restoration, and subscription status. Entitlement access may depend on accurate information from Apple, StoreKit, RevenueCat, and our systems.
9. Apple App Store Terms
If you download or use BeforeTheyGo through Apple's App Store, your use of the app is also subject to Apple's applicable terms, including the Apple Media Services Terms and Conditions and Apple's Licensed Application End User License Agreement unless a valid custom end user license agreement applies.
The app is licensed, not sold, to you. Your license is limited to using the app on Apple-branded products you own or control as permitted by Apple's usage rules and these Terms.
Apple is not responsible for providing maintenance or support for the Service. Apple is not responsible for claims, losses, liabilities, damages, costs, or expenses relating to the Service except to the extent required by applicable law.
You must comply with applicable export control laws and sanctions rules. You represent that you are not located in a country or region subject to a U.S. government embargo and are not on any U.S. government restricted party list.
10. Third-Party Services
The Service may rely on third-party services, platforms, SDKs, infrastructure, or processors, including Supabase, RevenueCat, Apple, Google, hosting providers, and other service providers used to operate, secure, support, or improve the Service.
Third-party services may be governed by their own terms and privacy policies. We are not responsible for third-party services except to the extent required by applicable law or by agreements we have with those providers.
11. Intellectual Property
BeforeTheyGo, including the app, website, prompts, design, interface, branding, logos, software, text, graphics, and other materials we provide, is owned by us or our licensors and is protected by intellectual property and other laws.
Except for the limited right to use the Service under these Terms, we do not grant you any ownership or intellectual property rights in the Service.
You may not use the BeforeTheyGo name, logo, branding, or materials in a way that suggests endorsement, affiliation, or sponsorship without our prior written permission.
12. Service Changes and Availability
We may update, modify, suspend, discontinue, limit, or remove parts of the Service at any time. We may also release updates that add, change, or remove features.
We try to keep the Service reliable, but we do not guarantee that it will always be available, uninterrupted, secure, error-free, or compatible with every device, operating system, network, or storage condition.
You are responsible for maintaining your own backups of important exported content and for protecting access to your devices and accounts.
13. Termination
You may stop using the Service at any time. You may also delete your account if account deletion is available in the app.
We may suspend or terminate your access to the Service if we reasonably believe you violated these Terms, created risk or possible legal exposure, used the Service unlawfully, or if we are required to do so by law.
After termination, some provisions of these Terms will continue to apply, including sections about Your Content, Privacy, Subscriptions, Apple App Store Terms, Intellectual Property, Disclaimers, Limitation of Liability, Indemnity, Governing Law, and Contact.
14. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, or security.
We do not guarantee that prompts, reflections, letter features, emotional wellness content, or any other Service content will produce any particular emotional, relational, personal, therapeutic, medical, or life outcome.
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
15. Limitation of Liability
To the maximum extent permitted by applicable law, BeforeTheyGo and its owner, service providers, licensors, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, content, device access, emotional distress, or other intangible losses arising from or relating to your use of, or inability to use, the Service.
To the maximum extent permitted by applicable law, our total liability for any claim relating to the Service or these Terms will be limited to the greater of the amount you paid to us for the Service in the 12 months before the claim arose or USD $50.
These limitations do not limit liability that cannot be limited under applicable law.
16. Indemnity
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless BeforeTheyGo and its owner, service providers, licensors, and partners from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or relating to Your Content, your use of the Service, your violation of these Terms, your violation of law, or your violation of another person's rights.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date and, where appropriate, provide notice in the app or on our website.
Your continued use of the Service after updated Terms take effect means you accept the updated Terms. If you do not agree to updated Terms, you should stop using the Service.
18. Governing Law
These Terms are governed by the laws of the State of California, excluding conflict of law rules, except to the extent the laws of your place of residence require otherwise.
If you live in the European Union, United Kingdom, Switzerland, Norway, Iceland, or another jurisdiction whose consumer protection laws require a different governing law or forum, you may have rights under the mandatory laws of your country or region of residence.
